Budgy is a budgeting tool, not a bank or financial adviser. You remain responsible for checking your accounts and making your own financial decisions.
1. Agreement to these terms
These Terms of Use (“Terms”) are an agreement between you and Budgy (“Budgy”, “we”, “us”, or “our”). They apply when you access or use the Budgy mobile app, website, and related services (together, the “Service”). By using the Service, you agree to these Terms and our Privacy Policy.
If you do not agree, do not use the Service.
2. What Budgy does
Budgy helps you organise financial information, create envelope budgets, classify transactions, plan upcoming costs, and view trends. Features may change as we improve the Service.
Budgy does not hold your money, initiate bank payments, extend credit, or provide a bank account.
3. Eligibility and accounts
You must be at least 16 and legally able to enter into these Terms. You must provide accurate information and keep access to your account, email, Apple account, and device secure. You are responsible for activity carried out through your account unless caused by our failure to use reasonable care.
Tell us promptly at support@budgy.nz if you believe your account has been accessed without permission.
4. Connected accounts and third parties
If you connect a financial account, you authorise Budgy and our bank-data provider, Akahu, to access and process the account and transaction information needed to provide the features you request. Your use of Akahu, Apple, and other third-party services may also be subject to their own terms.
You may disconnect a bank connection through the app. Disconnecting stops future imports but does not automatically delete information already imported into your Budgy budget.
Bank feeds can be delayed, incomplete, duplicated, or temporarily unavailable. You should check important information against your bank’s own records.
5. Acceptable use
You agree not to:
- use the Service unlawfully, fraudulently, or in a way that harms another person;
- access or attempt to access another person’s account or data;
- interfere with the security, availability, or normal operation of the Service;
- reverse engineer, scrape, or automatically extract the Service except where the law expressly permits it; or
- use the Service to introduce malware or bypass technical limits.
6. No financial advice
Budgy provides general budgeting information and calculations. It does not provide financial, investment, tax, accounting, or legal advice. Suggestions, classifications, forecasts, protected amounts, and available balances may be inaccurate or based on incomplete information.
You are responsible for your financial decisions, payment dates, account balances, tax obligations, and any fees or losses caused by relying on information without checking it.
7. Changes and availability
We aim to provide a reliable Service, but we do not promise uninterrupted or error-free access. We may maintain, change, suspend, or discontinue a feature where reasonably necessary. Where practicable, we will give reasonable notice of a material reduction or discontinuation.
Some failures may be outside our control, including outages or changes affecting banks, Akahu, Apple, internet providers, or hosting infrastructure.
8. Intellectual property
Budgy and its licensors own the Service, including its software, design, branding, and content. We grant you a personal, limited, non-exclusive, non-transferable, revocable right to use the Service in accordance with these Terms.
You retain ownership of information you provide. You give us permission to host, process, reproduce, and transmit that information only as needed to provide, secure, and improve the Service as described in our Privacy Policy.
If you send feedback, you permit us to use it without restriction or payment, but you are not required to provide feedback.
9. Ending your use
You may stop using Budgy at any time. You may request account deletion by emailing privacy@budgy.nz from the email address associated with your account.
We may suspend or end access if you materially breach these Terms, create security or legal risk, or misuse the Service. Where appropriate, we will provide notice and a reasonable opportunity to resolve the issue.
Terms that by their nature should continue after termination—including intellectual property, disclaimers, liability limits, and dispute provisions—will continue.
10. Consumer rights and liability
Nothing in these Terms excludes rights or remedies that cannot lawfully be excluded, including any rights you may have under the New Zealand Consumer Guarantees Act 1993 or Fair Trading Act 1986.
To the maximum extent permitted by law, Budgy is not liable for indirect, consequential, or special loss; loss of profit, opportunity, goodwill, or anticipated savings; or loss arising from inaccurate third-party bank data, an unavailable third-party service, or a financial decision you make.
Where our liability can lawfully be limited, our total liability relating to the Service will not exceed the greater of NZ$100 or the amount you paid us for the Service in the 12 months before the event giving rise to the claim.
11. General terms
These Terms are governed by New Zealand law. The courts of New Zealand have non-exclusive jurisdiction over disputes relating to them.
If part of these Terms is unenforceable, the remaining parts continue. A delay in enforcing a right is not a waiver. You may not transfer your rights under these Terms without our consent; we may transfer ours as part of a reorganisation or sale of the Service.
We may update these Terms. We will publish the revised version and update the date above. If changes materially affect your rights, we will give reasonable notice. Continuing to use the Service after the changes take effect means you accept the revised Terms.
